Well I think the case is going to end up in failure because as the article said they were the only ship foolish enough to go out, if it was a gross neglect by PAGASA then there would have been even more ships out there that would have possibly been sunk.

Sulpicio Lines has been involved in 4 maritime disasters in the Philippines since 1987. 3 of those involved ships sinking during typhoons.

Those 3 disasters:

1988: MV Dona Marilyn sinks during Typhoon Ruby.
Deaths: 389
Survivors: 147
Note: This was the sister ship to the Dona Paz. (more on that later)

1998: MV Princess of the Orient sinks during Typhoon Vicki.
Deaths: 150
Survivors: 238

2008: MV Princess of the Stars sinks during Typhoon Fengshen.
Deaths: 814
Survivors: 48

As for the other disaster:

1987: MV Dona Paz sinks after being struck by the tanker MT Vector, which was carrying 8,800 barrels of gasoline and other oil products. The cargo ignited and fire quickly spread on both ships, which sank in only minutes.

Deaths:
Dona Paz: 4364
Vector: 11
Total: 4375

Survivors:
Dona Paz: 24
Vector: 2
Total: 26

Note: This is the worst maritime disaster in peacetime. Due to the intensity of the fire, there was no wreckage of either ship. No more than 250 bodies were recovered.

The 26 survivors were only able to escape by swimming deep in the water and getting rescued by ships that were responding to the distress calls.
