Virginia isn't the only jurisdiction that wants him; he's up on Federal charges (ATF weapons violations, interstate flight to avoid prosecution, etc.), more murder charges in Georgia, Louisiana, Maryland, D.C. and Washington State, for openers.
Even if he doesn't get the death penalty in VA, he is far from "out of the woods".

Maryland has been liberal leaning on the issue of the Death Penalty, thanks to EX(I am so glad to say that)Governor Glendenning. The new governor, Mr. Ehrlich, a moderat republican is reinstating the death penalty, while the democrat in VA is probably considering repealing it. Plus this man may get knocked off in prison. I say just stand him in front of the firing squad and plaster him with bullets, like someone else here already suggested.
