Scott Peterson trial judge is to hold a hearing to discuss possible misconduct by a juror.

Yep... I caught the Alert on Court TV. They are going to eat lunch now and the media's been kicked out of the court until 4:30pm Eastern, 1:30pm Pacific.

I doubt that will happen. It's simply too long of a trial.

I think(someone correct me if I'm wrong) a lot of the evidence from this trial wouldn't be admissable in a new one. If that's the case, there's no way it'll be re-tried.

Correct, that is "collateral estoppel." A different judge would/may rule differently though if there is a new trial. A misconduct by a juror COULD happen this way:

The juror gets thrown out, and an alternative juror gets put in.

Yes, BUT, the deliberations have to start over from the very beginning in that case. What a mess.

it's not like they've been deliberating for weeks and weeks. Only 5 days so far.I've been on juries for lesser crimes longer than 5 days.

Yes and no. An alternative juror would have heard the entire case already. So he/she would be ready to go if needed. He/she may already have a thought about it anway.

I KNEW IT!! :grr:

I hope and pray the judge does not declare a mistrial!! This needs to be over and done with so Lacy and her baby can rest in peace and that family can begin to heal.

OMG, this can't be! I haven't been following the case very closely, meant to, just got busy. Dang. This isn't good news.

We all wanted Scott put away for years. And some a worse punishment!

Makes you wonder what Mark Hacking's trial is going to be like.
