I'm not a bank supervisor, but I personally think that they should honor any transactions that would be applied against that money that was depositted. You have proof that you depositted that money and it is yours. You should not be held responsible for any inconvenience/late fees/etc. incurred.

Thanks Stephanie! Its just sooo crazy! The branch manager called me at 4:30 today and said they still hadnt found the checks but were feverously still taking this machine apart. You know I just want them to put my damn money back in! if they or when they find the check, well terriffic for them but I didnt loose the check they did! I asked one of the ladies there about being F.D.IC. and she said well thats only if something goes wrong etc etc. ultimately though I think that they will be responsible if they cant find my check and other peoples that were mysteriously lost.

I was a bank officer for 10 years, The FDIC does not cover this, FDIC is for instances where banks go under it covers your account balance.
I have never heard of something so incompetent as losing a check in the machine. You can either wait and do what they say, or call whomever you received the check from, ask them to put a stop payment on it and issue a new check to you. The check obviously has not been cashed at the bank it is drawn off of, since it never left your banks processing area. (If they are telling the truth)Your bank should cover the stop payment fee for the company or person who issued the check.
We have had 1 incident of a teller losing a check, it was no where to be found, and the customer got a new one from the issuer and all was well although it was an incovienence for the customer. I could go on and on about the banking procedures, but I can tell you that you'd be amazed at the errors made daily and you should never take the banks word for it. Most tellers spend alot of time going back through their transactions on a regular basis to find out why they are "out of balance"...most times it is lost checks or lost deposit slips. ( I was a teller for 8 years prior to an officer fortunately I was usually "in balance" some are off daily) I hope this helps, but either way contact the person who issued it and make sure it hasn't been found and sent to their bank for cashing.

Be sure and keep your deposit slip that shows you deposited money. It is the only proof you have that you had a check with that amount. A long time ago, we had a teller embezzle money from our account. We deposited my husband check and paid bthe bills and a few days later we got notices of the checks bouncing. We went to the bank to see why since there had been money enough deposited to cover the checks we wrote. The only proof we had that we had deposited any money the was the proof of deposit slip we had kept. The bank then wanted to know what teller we went to . We said we went through the drive thru and the girl at the window was aNegro with short hair. We didn't know her name. It turned out she had been doing it to several customers and no one had complained until we did. She was arrested and charged with embezzlement. The bank had to honor the checks we had written since we had deposited the money in good faith expecting it to be there. We were not charged the bounced check fees either. So make sure you keep that proof of deposit slip.

I had a bank credit my deposit to someone else and it took months and months to straighten it out and of course I had written checks against it (I had my receipt but did not know anything had gone wrong until things began to richochet...)

Eventually the bank DID make good on the money and they paid some of the bounce charges (but not ones charged by other banks initially) and in spite of their writing letters of apology/explanation for me, my credit was all screwed up for YEARS because of this mess.

They actually deposited my money to someone in Montreal (not even in the same country!!!!) whose name was almost the same as mine--but the odd thing is that I have a VERY unusual name--and, as it turns out, a distant relative in Montreal...

Who could have guessed?

Anyway, good luck with the bank. You have to be VERY insistent and VERY persistent and keep all the paperwork.

Keeping your money under the mattress is safer, alas.
