This is the most DISGUSTING thing I have EVER read. Their CEO should be drug into a back alley and BEATEN BRUTALLY.

I guess I'm confused. If she was in a car accident, why wouldn't her auto insurance or the other driver's insurance cover the cost of her medical expenses? That's how it works here in NJ at least.
I didn't realize that health insurance plans offered by companies required that they get the money from any lawsuit. I wonder how common that really is.

Why should this make you stop shopping at Wal Mart? Court cases do not exist to enrich the "winner", they exist to compensate for specific damages. Wal-Mart, acting as her health insurance company, is just doing what all insurance companies do in recouping its losses when the injured party recovers damages in a suit. Her attorney is the one who should be blamed for failing to include long-term care as part of the damages in the lawsuit.

All health insurance policies will collect anything they paid out from any lawsuits regarding the specific incident. It's a standard clause.

As is common for employer-sponsored health plans, Shank's insurance required full repayment of medical expenses if she received money from a lawsuit.
Daphne Moore, a Wal-Mart spokeswoman, said the company sued "out of fairness to everyone who contributes" to the plan.
If i'm not mistaken the lost money will then come from the employees. Is that fair to them? What about the attorney reducing his fees? I'm sure he/she got a fair amount.

Wal Mart made 11 billion dollars in profits last year. It won't kill them.
I find it immoral, she can't even remember what happened 5 minutes ago, they sued her for more then she was worth. She can't even defend herself in court for god sake.

Tell that to the employees who put in for that insurance. They're the ones funding the insurance. Walmart is only following policy. If they do that for one then they have to do it for all.

Sure, this one case wouldn't hurt them much. But once they fail to enforce their contract one time, this will happen with eveyr case where the injured wins a lawsuit. It will add up quickly, then the employees will have to increase their contribution to the health care plan.

The family violated the contract. There's no way to recover without suing. Blame the woman's attorney for not doing his job properly.

I can understand, but it's not this womans fault, it's just a complete mess because the person in the middle of it is hardly functional and god forbid people can settle things out of court.
I just see something wrong with suing a vegetable.
I'm just an idealist I guess.

I can't reiterate this enough: in this particular case the fault lies entirely with the family's attorney. He should have included the estimated cost of her long-term care in the damages for the suit, but failed to do so. Had he done his job, they'd have had the money to pay back Wal-Mart plus a nice nest-egg to ensure her quality long-term care. They should be suing the attorney for malpractice rather than badmouthing Wal-Mart for enforcing the terms of their contract.
I am no fan of Wal-Mart, but in this case they are not int he wrong. If they fail to collect in this case, they basically lose that provision in their health insurance plan contract and will have to increase employee contributions to pay for the losses. Then guess what? They're seen as the bad guy anyway.

Hmmmm....got me wondering. My wife is a breast cancer survivor. She is also part of a group involved in a lawsuit against Kuhlman Electric and PCB contamination. PCB's are a known carcinogen. When this deal settles I wonder if we will be required to repay our healthcare provider?
The amount of money seems large.....but I'm here to tell you that NO amount of money is worth what she has endured.

Very. It is the insurance company's right to recoup the money if another party is responsible. Though my accident was not as serious as this woman's (obviously) this very thing happened to me. It is in the insurance contract.

She does have the option of filing a claim against the person responsible for the accident. She can in fact garnish this persons wages to satisfy any court judgement in her favor.

They sued the insurance company, correct? Not the individual? Unless I've misunderstood something.

LOL.. your right, Target is better then Wal- Mart. Shopping in Wal-Mart reminds me of scenes from the movie Escape from New York.
