This is just horrible A mother in Texas who cut her tenth month old daughters arms off and left to die accually is going to avoid prison and sent to a mental hospital so she says so she can better. why cant someone be guilty due to insanity??????

i dont have a problem with her going to an institution as long as she has no chance of getting out.

It's possible that she may end up spending more time in the mental institution than she would in prison. I'm reminded of the guy who shot reagan, he'd probably be out now had he been convicted rather than be found "not guilty by reason of insanity", the sentence would likely have been set with a specific time frame.

I think parents should love and care for their children.

i think you're right, but unfortunately strange and horrible things occur from time to time.

Well, infanticide can be a problem in certain species and their have been case studies that humans do it as well. But what is so bizarre is that there was no other male companion that she would have needed to commit this crime. I don't buy the insanity plea because the mind psychologically knows what is intends to do, but the body does it anyway. It is not the person that performs the acts, it is the mind telling the body to do it. Even, if she was insane, there are medicines that can neutralize or correct the chemical imbalance...

I think the insanity plea is BS and should be abolished. Take ppl like this and lock them in solitary forever..or better yet execute them.

Somewhat agreed george... I think there are certain cases where you could use the insanity plea but, as far as something this extreme it is beyond sick and that person does need to be locked away.

those saying that people cannot be insane really irks me as a scientist. I understand the emotion, but we did not listen to any of the evidence as to what the scientists presented at the trial. To punish someone who really has something wrong with them would take us back to the days of the Reich, which many would be screaming just as loudly over

I didnt say ppl cannot be insane. I mean insanity should not be a defense to committing a crime.

however, if a person really has no conception of right and wrong due to a severe mental defect, should he/she be put in prison, or sent to receive the help they should have received years ago if our beaucratic gov't would have done the right thing and helped them then?

Put them in prison. They can be "helped" there.

Dang, that is life in maxium security prision, if I have ever seen it. That piss me off big time.....

I read about that horrible story last Thanksgiving I believe. Very similar to the Andrea Yates case. Just plain sick. And what a cruel way for that baby to die! She should be fried and suffer like her poor innocent child did. Did you know that Susan Smith will be eligible for parole around the age of 53? That is another sicko that should never, ever be let out. I am sure none of you ever forgot that horrible crime of the young mother from South Carolina who drowned her 2 young sons. Michael 3 and Alexander 14 months in a lake. Then, lied about it for 9 days! Saying her sons were instead kidnapped and she was carjacked at gunpoint. All to win the affection of her then boyfriend who did not want children. Pure selfish!

Charlie Manson was institutionalized in the California Facility for the Criminally Insane back in the 1960's-he's still there. Last time he came up for review, the Board quite literally gave him the raspberry. Sirhan-Sirhan in regular prison for killing RFK in 1968 was recently denied Parole because to this day he still shows no remorse for the crime. So, not all of the looneys get out. In fact, as was pointed out earlier, Hinckley (who shot Reagan) probably would have gotten out in 6 years but remains in a psychiatric ward. However, correct me if I'm wrong but I think the guy who shot John Lennon has been released.
