Have any of you had to deal with any of the officers from the IRS? Is there a way to file a complaint against an officer and possibly have another officer assigned to your case?

The reason I am asking is because the company I work for had a so called accountant in 2004. She never filed federal quarterly taxes (914). When I started here back in September 05, I walked into a total mess. No payroll taxes were paid, I had no paperwork to even take a guess at wages earned or what was withheld. Did not even know what happened to the money she withheld because she sure was not making tax deposits. So, I put everyone on payroll through a payroll company. The Alabama Dept. of Revenue called me one day because they saw where someone was actually making tax deposits. He saw that I was trying to straighten everything out and worked with me on all the stuff that was not filed or paid. That is all done and paid. Well, here comes this man who thinks he is God and starts a levy on income for the business. He offered no explanation and in his report he states that this business has not paid ANY taxes, AT ALL the entire time the business has been in operation. I told him that he was out of line not to mention WRONG, and that we would just shut the business down and file bankruptcy. He said to me "Well, that is good" I mean WHAT?? THAT IS GOOD? It is good that a business is going to stop operating? I could not get this man to work with me AT ALL! He told me he was retiring in two months in which I replied "Well, that is good" :D I also told him, more or less, good riddance.

I believe his "God-like mindset" is racially motivated. Matter of fact, I know it is. Should I call an ethics hotline?

So, this is why I am asking the questions.

This guy has got to have a supervisor he reports to. What about the guy from the Alabama Dept. of Revenue? Does he have contacts or can he give your any suggestions?

Is there a lawyer that you know of that deals with businesses and their tax problems with the state and the federal government? I would probably go that route first so you are "protected" before going forth with a complaint, etc.

Matter of fact, Steph, I did contact the Dept. of Revenue guy. He got on the phone with this fellow and was given the same treatment as us. He is state and this guy is federal. :roll: Although, it may have done some good because the federal guy is now communicating and giving me exactly which forms I need to get the 18 wheelers straightened out, as far as Heavy Hwy. use taxes. There is no documentation for me to show any losses, no expenses on the trucks, nothing from 04 and part of 05. All I have is what I started, which is not enough to show a loss. I do not understand that.

This company does not owe the state a dime. I fixed that. Was working on the federal when he reared his ugly head making threats. What bothers me is we tow for the Border Patrol. When the driver got to the interstate, this agent was telling the driver what to charge. The driver said "Is that legal?" He said "Son, we are the federal gov't, we can do anything we want to do" That is what keeps sticking in my mind when you refer to this federal officer. **sigh**

Some definately have a "God complex" like this moron which is a shame when a company such as yours is trying to do the right thing.

I think though that since you don't have "proof" that the company didn't have a loss for 2004 and 2005, they can assume otherwise. Everyone would report a "loss" then. The company was a going concern back during that time period so they can make an "assumption" that since the company didn't go under they can perhaps charge them a tax. They may end up using the information that you do have now as a base for the prior years. Don't think for one minute that they are not going drop this whole case without a dime being paid. This is where you may need that lawyer. It's good though that the guy from the state has helped you and seems to have pushed a few buttons.

Linda, your in Bre's area now, I hate em all and have to deal with them too. Exactly what taxes is the Ala. Dept, of Revenue asing for. Sales Tax? I am a little confused, but maybe can help you

Linda loo hoo.....check your PM I had the exact same situation with one of my accounting clients....but my answer is way too long to fill up in here. I might be able to help you out.

Bre, I straightened out the state taxes. This is the federal man. The 941 Employer Quarterly Federal Tax Return. I am missing 2nd and 3rd quarter filings 2005. 2nd, 3rd quarter filings for 2004. There is no paperwork at all. I do have year to date wages earned plus W-2's from 2004. Somehow the previous bookkeeper submitted wages to the payroll company when she hired them in October 2004. Well she didn't, one of the partners did. But, this IRS man wants those 941 and 940's from those quarters. I have asked the bank to make me a hard copy of all the bank statements from 2004.

When I started in Sept. 05, made everybody fill out applications and all the tax documents. I then hired a payroll company and sent everything to them. They have doing all of this since.

The business is using a CPA and we were told today that the previous bookkeeper admitted to him that she erased company files (all of them) because she was not paid. Is that criminal?

Oh I'm sure it is if it can be proven. I suggest you let your CPA deal with the Feds, that's what I do. They do the annual taxes and should have some type of info. If you don't want to do that I would call the IRS and tell them about this guy calling you and tell them the situation about what happened and ask them what to do, they will probably use the 1st and 4th quarter filings to estimate your taxes, plus interest and penalties . Don't mess with that guy, you don't have the reports plain and simple, he should be working with you not against you. Same thing happened to me a few years ago when started my job, what a mess but at least I did have records to use to prepare the 941 reports.

Good advice Bre. This bookkeeper actually told the CPA she did this. I just found that out this morning. Ah the drama. I want him (federal guy) to show me what to do, what I need to have, etc. for next year. That way, I am not in the dark and will have everything ready for the CPA.

Then you know EXACTLY what I am going through Bre.

I tell ya what though, I have a new found respect for accountants. My hats go off to all of you!

I didn't realize that the company had a CPA company working for them. I would most definately have the CPA work on this WITH YOU. This way you will have "backup" and support when this IRS guy comes calling again. They should also know who to contact and what needs to be done. That's one of the reasons why they are also being paid - to make sure that everything is accounted for correctly. If the payroll wasn't accounted for correctly, THEY need to know that as well.
