From KXAS NBC 5

FORT WORTH, Texas -- A Dallas jury is back at work, deciding the fate of a teenager accused of killing an Irving waitress with her car.

Sarah Foust, 19, wept when she took the stand on Thursday.

She says she was heavily intoxicated when she struck and killed Jennifer Sanchez, 20, in January.

Before arriving at the Bennigan's restaurant in Irving, Foust said she and her friends planned to run out on their bill. What they didn't anticipate was Sanchez running after them.

When asked about her laughing on a police car videotape minutes after the incident, she testified Thursday, "I don't know, I'm very ashamed of that videotape, I'm very ashamed that I got that drunk and I don't know what I thought was so funny."

Jurors must now decide if Foust is guilty of murder or manslaughter.

If convicted of murder, Foust could be sentenced up to 99 years behind bars.

That was a 2nd woman I've seen cryin' in court this year.

Sadly enough too many people use their impairments whether it be drugs or alcohol as an excuse. I don't drink now but back in my drinking days I would blame alot of my actions on my drinking.

My husband lost his best friend at an outdoor party as a young adult. There was a party of over 100 people in an isolated park in Florida. My husband's friend (Carlos) got into an argument with another person. The person Carlos was arguing with staggered away from the argument and got into his car. He started it but nobody heard it over all the car stereos playing loudly. This man never turned on his headlights. He simply put the pedal to the metal and floored it. Carlos was directly in his path. He died an hour later in the emergency room with multiple head injuries. The person who killed him was judged guilty of manslaughter. He was sentenced to seven years. He got out in three.

Everyone who was affected by the loss of Carlos was furious that the sentence was so mild. I suppose I wouldn't be impartial enough to be on a jury, but my thoughts are simply this: The woman should pay for her crime. The restaurant does carry some of the blame for serving a minor, however the main guilt should fall upon the woman driving the car.

Maybe I'm missing something here, but did it come back as manslaughter or murder? I do agree that this young lady should be held accountable for her actions and should not be allowed to hide behind the excuse of intoxication. Murder is murder. Simple as that.
