The latest GFS runs do indicate a fairly good amount of 850 mb vorticity, but who knows.
It's not just an upper level low. It already has a well defined (998 MB) surface reflection. It's simply cold core (ET) right now.

No worries, it's about to get swallowed up by a larger ET low to it's north in another day or two.
