We've been sent an eviction notice...!!!
Moderator: S2k Moderators
Bill just another option - not a solution but an alternative - do you have any extend stay hotels in the area that you might be able to stay at if you do get evicted. They usually only cost $190 to $200 a week. I know its not cheap - but it would beat living on the street.
And yes Storm2k'ers are stepping forward and assisting. Amen to them all for their prayers and monetary contributions.

Bill, I just can't believe that they can give you a 15-day notice and then basically throw you out in the street. Must be that the laws are different in Missouri. The laws here are more tilted more towards the tennant.
I would have to believe that whatever agencies become involved, if any, they would make every effort to keep the family together.
I know that things always seem the darkest right after receiving bad news. Once the shock wears off, you make contingency plans, gather your resources, and get busy. This is a setback to be sure, but I trust that no matter where this takes you, you'll get through this.
Sounds like you may be better off without this landlord. A year from now your situation could be much better.

We have about four hotels here; all of them across the line in Miner. These also have a city-mandated "tourist tax"...why, I have NO idea...and at $200+ for a suite for 3, it's too expensive to contemplate.
Bad news came up; the City of Sikeston, and Scott County MO are trying to drop Section 8 applicants by 25%; they are merely waiting for HUD to approve this.
Good news, too...we found a HOUSE for rent, at $50 less per month than we pay to live here. If we can secure it...
As of today, we have $37 in our account, and still 18 days before our SS checks come in...12 or 13 before we have to leave. This is FYI, only.
coriolis, Missouri Statutes provide for 15-day evictions with notice...unusual compared to other states. And the lease agreements are always written in favor of the landlord, so I've been told.

they may be written to the good of the landlord, but missouri law sanitation statutes take over. in your case, the landlord will lose. when she loses, she will be setting herself up to be sued.
she also had no right to come in and take those pictures. she mislead you as to the reasons for entering, which is a clear violation of her own lease agreement.

Once again my friend, I have contacted a couple more sources in and around Sikeston on your behalf should the need arise. I'm hopeful all will settle down and life will go on as normal...but should it not, it appears there may be intervention available if you'll open your doors and your hearts to talk with some local folks. Best wishes....get some rest in the meantime...

Steve, thanks for the help!
What is ugly about all this is that we learned from some people we know that the "bug problem" may well be an excuse...what the landlord really wants is to completely renovate this apartment and, having done so, raise the rent for a new tenant.
They could have told us that...but, either way, as I understand it, the landlord is responsible for responding to calls for maintenance in a timely (14 days after complaint) manner, and they failed to do that....and we, for that matter, didn't have the means to employ an outside party, so we did what we could with commercially available insecticides, sprays, "motels" and foggers.
As to rest...yes, that's exactly what I'm doing today. *chuckling* I have muscles aching in places I didn't think I HAD muscles! Debi is going up to STL this afternoon to retrieve coppertop from his vacation trip; among other things, he got to see "Jay and Silent Bob's" comic book store in Leonardo, NJ
this trip, and Jan tells me he's been an "angel" :o LOLOLOL

Well, I can only say I hope A BIG FAT lawsuit can be filed on your behalf Bill. In the meantime, keep looking for a new place. Like Steve, at el have said, when one door closes, then another one opens and I can't help but think that you're being forced to go and live in a place that is better maintained and cared for. You guys deserve it! We'll take care of the prayers and $$ as much as possible on this end. You focus on getting a new home and resting!

Latest update...
We applied to the Housing Authority, but they have no "emegency" housing available, and we were told that we'd recieve a letter in about TWO WEEKS (????). The clock is ticking at 13 days and counting...
I also contacted the Missouri Masonic Home Outreach Director; she is to call around, and let me know some time today what's up.
As to apartments? None yet, but still looking.
This afternoon, we are going to the Department of Social Services...meanwhile, I have registered and left a request with a website called Modest Means (thanks, FreakyWxChick!)...
"Rest"? LOLOLOL! I'm busier than a one-legged man in a butt-kicking contest! More as the scenario develops, folks...

So much for the Department of Social Services; they have been cutting back for the last 18 months, and under the new guidelines as established under The Honorable (?) Governor Bob Holden, our Social Security and dependent's income (combined) exceeds the limit for assistance for a family of three...

So much for giving the people THAT ARE ABLE TO an incentive to "work for a living".

Keep at it Bill! what about Legal Aid as you said before? Can they help you at least win a reprieve until you can find something?

Tom Martino is a consumer advocate and he can get FIERCE on the phone on his radio show when he calls up the bad guys.
Check his site and give him a ring. 1-866-966-9696 24-hours a day. You won't necessarily be on the radio, but he could help alot.

Legal Aid is in Charleston, about 20 miles east of Sikeston; they took the information Friday, but told us they would send a letter to us (confirmation or denial) which should arrive by mid-week....we have no way of knowing which way the wind blows.
More apartment hunting going on...so far, nothing has turned up.
As to that radio show, I don't know if it even airs here; I've never heard of it.
