Me and my wife filed Bankruptcy and it is now been Discharge.Here is the question when me and my wife payed the lawyer and he told us to make sure we tell all the bill collectors that we did file for CH 7 Bankruptcy and to make all calls to his office.Everything went great for couple weeks until one loan company kept calling,but we were not home the caller ID pick it up.I did copy the date and times they did call because our lawyer told us too.One night they called I answer and he ask me when are we going to make payment!!!!!!I told him that he have to talk to the lawyer.He said that he talk to the lawyer and we have not pay him yet.Which I know I did because I had a copy of the check!!!!Then he threat to bring the cops to the house that moring if we did not make payment to have us arrested and take everything in the house!!!
That moring I went to my lawyer office and told him what happen he was pissed!!!!!!!!!He called them told them not to call us again!!!!!!which they did 3 times but we did not answer the phone.We wrote down ALL times they called from the begining to the end.NOW should we go though with a law-suit aganist the loan company they did broke Fair Collection Act laws and our lawyer think we should also BUT I need that second opinion.

Sue them for what? Calling your home wanting payment? If so, then that is nothing but a waste of time. You can call your state attorney general and inform them you are being harrassed by this company because you are in bankruptcy and they are demanding payment. The company will then be fined by the state under that Act.
Second, that company is misleading when they say they can bring the cops to your house to have you arrested. That is about the funniest thing I have ever heard. Tell him to send them right over, call their bluff. Bet they never show up.

The law is pretty clear about what they can and can't do. If they go over the line, you CAN sue them. Talk to your attorney.
I talked to a attorney for the state and he said the same thing.All we have to do is file a $100 to the courts!!!!They broke state laws and Federal laws and our attorney will make them pay for his fee!!
