#1 Postby BUD » Fri Sep 08, 2006 12:25 am

I have a friend that lives 3 miles from me and rents a little home from this old lady that is very nice. She lets me shoot my high powered air rifles and lets us fish. Now she has been thinking about selling and she has a lot of land plus it on the intercoastal water way.She wants 3 mill for the whole lot.Now here comes the problem a guy came over and told her he will give her $50,000 and that it!!!!She said no.The guy said take his money or he will take the land from her by( that law that I cannot spell). This guy wants to put up condo up.I live in SC.This old lady does not have alot of money so a lawyer is out of the question,so is this illegal in my state??I think there was a law passed not to long ago to make it illegal in this state.I need the info for my state thanks. If this guy can do this to her then whats going to stop him from doing this to me or anyone else????

I'm not sure which law you are talking about. Try this site http://www.scstatehouse.net/ you might be able to find the info you are looking for. Also, if this lady is elderly - you might find some help with an advocate for the elderly in your area.

Good luck. Hope that guy stops bullying the lady.

ask around for a lawyer someone could recommend. They will usually give you a free consult and maybe something could be worked out. If she does sale - they would get their fee then - thus protecting her from taking this offer.

It's called eminent domain and it is illegal in South Carolina. The only time it is used is by the state, usually to build a highway. But even then, the state must pay at least fair market value.

As an example of this law in use, Honda tried to build a plant in Florence County in the 90's. A single homeowner refused to sell and the whole project had to be moved to a different part of the county.

There are a LOT of crooked real estate developers in the Myrtle Beach area and this is just one who is trying to take advantage of an old woman.

If he contacts her again, have her tell him this:

Please refer to the procedures of eminent domain, Title 28, Chapters 2 and 3 of the South Carolina Code of Laws, 2005 revision. Any further contact will be from my attorney.
