Yet another, updated article, which states the first shot missed. That is not what I heard on the radio report today. Also the boy used an expletive word towards Martin. Still, that's certainly not a reason to shoot someone!

New Details: Man Accused Of Murdering Neighbor Boy

New details have been released in the case of a man accused of killing a neighbor boy who stepped on his lawn Sunday.

On Wednesday, a Clermont County grand jury indicted Charles Martin, 66, on one count of aggravated murder. He won't face the death penalty because the case doesn't meet the criteria, Channel 9's Tom McKee reports.

Martin shot Larry Mugrage, Jr., 15, outside of Martin's home in the 800 block of Hawthorne Drive in Union Township on Sunday evening, police say.

According to the newly-released indictment, Martin fired two slugs at Mugrage from a .410 shotgun.

The first shot missed, the report reads, but the second shot hit Mugrage in the back, just below the left shoulder blade and exited his chest.

Mugrage, a straight-A student at Glen Este High School, was taken to the hospital but did not survive.

Martin called 911 after the shooting, telling them he "just killed a kid" and that he shot the boy twice with "a G** da*n .410 shotgun."

Martin told the dispatcher the boy and his parents had been harassing him for about five years.

Before the shooting, Mugrage had shouted an expletive at Martin, the indictment reads.

Funeral plans

Visitation for Larry Mugrage will be Thursday from 4-8 p.m. at T.P. White funeral home in Mt. Washington.

The funeral will be held Friday morning at 11 a.m. at the First Baptist Church of Glen Este on Old State Route 74.

Funds set up

Two funds have been set up for the family of Larry Mugrage:

Sharefax Credit Union on SR 74 in the Willowville area of Union Township. "Memorial fund for Larry Dean Mugrage."
Any PNC Bank. "Larry Dean Mugrage Fund."

I don't know but If I'm sitting on the jury to determine damages, I'm inclined to greatly reduce the award given that the teen could have easily prevented his own death, by respecting the man's wishes to stay off his lawn.

If Martin had been smart...he would have installed a fence and gate for his front property, also. As he had a fence for his backyard. The guy is/was a yard "basket case" to the extreme.

I don't think whether or not Martin had a fence installed in the front or back of his house is relevant to the debate.

I respectfully beg to differ...but we can just agree to disagree on that point.

I don't think it makes a difference whether or not he has a fence. If he doesn't want people on his lawn, and people know he doesn't want them on his lawn, why does he have to put up a fence for his wishes to be respected? Why can't people simply respect other's lawns, simply knowing that those lawns don't belong to them?
