Mansfield man to face charges in kidnapping

MANSFIELD, Texas (The Dallas Morning News) - Officials planned to arraign a 37-year-old Mansfield man Monday on charges of kidnapping and child endangerment after his wife’s 7-month-old grandson went missing for several hours, police said.

Mansfield police issued an Amber Alert on Sunday for Joshua Matthew Martin, who was last seen with Larry Stoxstell around 12:30 a.m., Mansfield police spokesman Thad Penkala said.

Joshua’s mother had just returned from shopping with the baby, another child and Mr. Stoxstell when she took the other child inside her home. When she returned outside to retrieve Joshua, both Mr. Stoxstell and the baby were gone, police said.

Mansfield Officer Danny Baas said the family initially thought the man would return with the infant, and they waited before an Amber Alert was issued. Mr. Baas said Stoxstell had given police "some reasons for his absence."

Stoxstell was arrested on an outstanding Dallas County warrant when he returned home around 8:30 p.m. Sunday.

"I didn't take the baby," he said as police led him away in handcuffs.

He was in the Mansfield jail Monday awaiting arraignment, Mr. Penkala said.

Mom pleads for safe return of toddler

IRVING, Texas (WFAA ABC 8) — An Amber Alert was issued late Thursday afternoon as police continued their search for a toddler who was last seen at a city park in Irving.

Sources said the two-year old was with his family Wednesday playing in Lively Park just off O'Connor Road when they noticed he was missing. The boy's brother told searchers that he last saw his brother on a trail leading to some nearby woods.

While authorities originally believed the toddler may have gotten lost in the wooded park, they now said they believe he was possibly abducted.

Majano's mother pleaded to the public for help in the safe return of the young boy.

"Please help me find my son," said Yancy Majano through an interpreter. "Please return him to me."

Elian Majano is described as a young Hispanic boy who was wearing a white shirt, flowered shorts and flip-flops.

Majano said the two boys ran out of the car when they arrived at the park. She then claimed only minutes later when she attempted to catch up with them, she only found her older son Alex.

"I asked him, 'Where is Elian?'" she said. "He said, 'He is not here.' I couldn't find him. All the people were helping me look for him, but I couldn't find him."

Search teams set up a command post behind Lorenzo de Zavala Middle School; and rescue dogs and a helicopter equipped with infrared sensors scoured the woods.

Police said they only had an hour-and-a-half worth of light to look for the boy before darkness began to cover the area.

"The darkness was against us, but now we're hoping he will come to the light," said Officer David Tull while searching for the boy Wednesday night. "We think he is just lost and stumbling around out there, but were not sure. We don't have any indication of foul play at this point."

City crews were relieved to find no sign of Elian after draining a sinkhole Thursday morning.

As time went by, police began other avenues in their search for the boy. Police also visited nearby registered sex offenders.

"There is nothing to indicate he has been in this area through the overnight," Tull said Thursday afternoon. "So, we have to make the logical assumption now that an abduction has probably taken place."

Mom was with boyfriend when son went missing

IRVING, Texas — The mother of a boy missing for almost two days has admitted she was in a car with her boyfriend and had left her son unsupervised at the time of the abduction, officials say.

Two-year-old Elian Majano disappeared while playing in Lively Park on Wednesday afternoon.

Child welfare officials have taken custody of the missing boy's brother, 4-year-old Alex.

Yancy Majano said she was unaware what she was signing when she filled in documents turning her son over to Child Protection Services.

"I've never left them alone. I've often taken them walking with me. An accident can happen to anybody. Today it happened to me. Tomorrow it can happen to any other person," she told reporters.

A CPS spokesperson said there might have been inadequate supervision the night Elian disappeared.

After an exhaustive search of the wooded area near the park, Irving police issued an Amber Alert for the boy, and the FBI has now joined in the investigation.

Police said they waited 24 hours to issue the alert because the case did not initially meet the established criteria.

Majano maintained that she is a good mother. "Ever since I had Elian, I have not worked, so I can stay home and care for my children," she said through an interpreter.

While the FBI is now involved in the search, police were no closer to finding Elian than they were Wednesday night.

Tips are coming in. A man and his nephew were stopped near Carter High School in Dallas Friday morning when someone mistook the small child for Elian.

But the brief flurry of activity led to disappointment. "We were hopeful, but just unlucky," said Dallas police Sgt. Lonnie Alan.

Elian is two feet tall, weighs 40 pounds, and has black hair and brown eyes. He was last seen floral print shorts, a white T-shirt and Spiderman sandals.

Missing boy's scent tracked to sinkhole

IRVING, Texas - The bloodhounds also tracked 2-year-old Elian Majano's scent to a sinkhole, which was about 100 feet from the parking lot. Police searches last Wednesday and Thursday of the sinkhole, the 25-acre Lively Park and the surrounding neighborhood turned up empty. An Amber Alert remains in effect for Elian, who was last seen about 6:30 p.m. Wednesday while playing with his 4-year-old brother, Alexis.

The documents were released as part of the custody case involving Elian's brother. Child Protective Services officials took custody of Alexis because of concern about the lack of adequate supervision for the children. CPS officials also cited the different version of events that Yancy Majano told police when her son first went missing as cause for taking Alexis into protective custody.

Ms. Majano initially told CPS officials that Elian ran off while she was taking Alexis out of the truck.

CPS spokeswoman Marissa Gonzales said Ms. Majano told investigators it happened quickly but later changed her story to say she was in the truck while the boys were outside.

Irving police officer David Tull said Monday that police have not ruled out the sinkhole or the possibility that Elian was abducted.

The sinkhole was caused by a broken pipe that was discovered last week during the search for Elian. The Trinity River Authority has been monitoring its plant at Loop 12 and Interstate 30 for any signs of the boy. There are about four or five miles of underground pipeline from the break at the park to the plant.

"We've been monitoring flows in the treatment plant," authority spokesman John Jadrosich said. "We haven't seen any remains. We're going to continue to monitor."

Police said they have received 38 tips so far on the hotline set up during the search for Elian. Anyone with information should call 972-721-8080.

Search for missing boy leads to water plant

GRAND PRAIRIE, Texas — Authorities were searching a water treatment plant Wednesday morning for any clues in the disappearance of a two-year-old boy.

Elian Majano vanished a week ago while he and his brother were playing at Lively Park in Irving.

The focus of the tireless investigation shifted to the Trinity Water Authority water treatment plant in Grand Prairie late Tuesday when Irving police detectives arrived, apparently to monitor incoming sewage for any signs of the child's body.

Police said no remains had been discovered at the plant, which is five miles from the park. They would not comment on the level of law enforcement activity overnight.

Police bloodhounds had traced Elian's scent to an area near an 18-foot-deep sinkhole at Lively Park, but no other sign of the youngster has been found.

An Amber Alert remains in effect for the youngster. Investigators said they have received more than 40 leads in connection with the case.

Skin found at water plant 'not Elian's'

GRAND PRAIRIE, Texas - Police say a sample of skin found at the Trinity Water Authority water treatment plant, which was thought to be a possible clue to the whereabouts of Elian Majano, came from an animal.

Elian went missing a week ago while he and his brother were playing at Lively Park in Irving.

The focus of a tireless investigation had shifted to the Trinity Water Authority water treatment plant in Grand Prairie late Tuesday, after police bloodhounds had traced Elian's scent to an area near an 18-foot-deep sinkhole at the park.

The plant is located five miles from Lively Park.

Irving police detectives have been monitoring incoming sewage for any signs of the child's body.

"There are going to be some things that are not readily identifiable that come through that system," said David Tull from Irving Police.

"We are going to do our best to indentify anything suspicious or indentifiable. We're looking if it's a cloth, or a shoe," he added.

The skin which turned up in the system's screens last night was initially feared to be human but tests found it came from an animal.

An Amber Alert remains in effect for the youngster. Investigators said they have received more than 40 leads in connection with the case.

Amber Alert for missing Missouri boys

EULESS, Texas — Two missing children who are the focus of an Amber Alert in Missouri may be headed to North Texas, police agencies said early Thursday.

The two boys— Kodiak Brown, 3, and his nine-month-old brother, Kennerick—were abducted from their grandparents' house in Linn, Mo. on Wednesday night.

The Osage County, Mo. sheriff's department said the children are believed to be with their non-custodial parent, Keith Brown, 48.

Brown is a former police officer from Springfield, Mo., who is considered armed and dangerous. He currently lives in Euless, which is why authorities believe he may be headed to Texas with the boys.

He was last seen driving a 2006 blue Dodge Caravan minivan with Texas license 083-LGC.

Keith Brown was described as six feet tall, mostly bald, with brown eyes. He was wearing a baseball cap, checkered shirt, and brown pants with a fanny pack.

Kodiak Brown is 3'-1" tall, 32 lbs., with brown hair, wearing a light-colored shirt and black and red shoes.

Kennerick brown is 2'-2" tall, weighs 17 pounds and was wearing a yellow onesie and blue socks.

Missing Missouri boys found

EULESS, Texas — Two missing children who were the focus of an Amber Alert in Missouri and believed headed to North Texas have been found unharmed and are now with their mother, an official said Thursday.

“The children are safe with their mother,” Osage County Sheriff’s Department dispatcher Tanya Douglas said.

Kodiak Brown, 3, and his 9-month-old brother, Kennerick, were abducted from their grandparents' house in Linn, Mo., on Wednesday night. Douglas said they had been located Thursday, but she would not give additional details.

The Sheriff's Department had said the children were with their non-custodial parent, Keith Brown, 48, and were likely headed to his hometown of Euless.

Brown was still at large Thursday and faces charges of assault and interfering with custody, Douglas said.

Keith Brown is a former police officer from Springfield, Mo., and is considered armed and dangerous.

He was described as six feet tall, mostly bald, with brown eyes. He was wearing a baseball cap, checkered shirt, and brown pants with a fanny pack.

Toddler didn't meet Amber Alert criteria

Irving: Case lacked proof of kidnap, but chief says he 'couldn't rule it out'

The Irving Police Department could face an informal reprimand for issuing an Amber Alert for 2-year-old Elian Majano, who disappeared from a park more than a week ago and is still missing.

Evidence of abduction is a requirement for activating the regional alert system, but Police Chief Larry Boyd said there was no such evidence in this case. The task force that runs the local system reviews each alert to determine whether it was warranted.

There were "no signs of abduction, but we couldn't rule it out," Chief Boyd said.

Elian disappeared in Lively Park on June 21 while his mother was sitting in a truck with a man described by authorities as her boyfriend. The toddler and his 4-year-old brother were playing outside at the time.

Police are unsure whether Elian was abducted or fell into a sinkhole that leads to the sewer system. Authorities said that there's no evidence to support either theory but that no other option makes sense.

Chief Boyd said it was important "to err on the side of caution and make sure the maximum amount of people heard about the child."

Tarrant County Sheriff Dee Anderson, a member of the local and state Amber Alert committees, said the system wasn't created only to drum up extra media coverage or to determine what happened.

He said the system should be used when police know that an abduction has occurred and there is sufficient information to help the public spot the kidnapper and child.

"I do not like to Monday morning quarterback this without full knowledge of the case, but my overall obvious concern is that there was never any evidence of an abduction," Sheriff Anderson said. "To my knowledge, there still isn't."

In Elian's case, police had a description of the boy and his flower-print shorts and Spider-Man flip-flops. But there were no other details about what might have happened to him.

Sheriff Anderson said that improper use of the system often happens when there is pressure from the family or media to issue an alert or when an investigation has stalled. He said the task force has written many letters during the past two decades reprimanding departments for using those criteria.

Capt. Richard Holland of the Houston Police Department said he could sympathize with Irving's decision.

"It's one of the most challenging calls that a law enforcement agency is asked to make," he said.

Capt. Holland, a member of the Houston regional Amber Alert committee, said that when other possibilities are eliminated, a department has to assume that a child has been abducted.

"If you have a very young child, sometimes you have to make that presumption," he said.

Strict rules

Most Amber Alert systems use standardized criteria for when it should be activated, such as evidence of abduction and risk of harm to the child. But there are some differences.

The Texas Department of Public Safety operates its own statewide Amber Alert system with even stricter rules. Elian's case would not have been eligible for that alert because a description of the suspect is required.

Lisa Block, a DPS spokeswoman, said that such stringent standards ensure that the system isn't overused and remains effective. Since the system was created in August 2002, DPS has issued Amber Alerts for 27 children. Twenty-five were returned safely, one child was killed and one is still missing.

"The suspect information is vital to what we do," Ms. Block said.

Statistics for the North Texas regional Amber Alert system were not immediately available.

The Amber Alert for Elian has been active for about a week and half, far longer than the usual one to three days.

Alerts stay active

In the Houston area, the regional committee does not rescind its Amber Alerts until the child is found. Since the regional system was created in 2000, there are three subjects of Amber Alerts who are still missing.

Each of those is still listed as active even after several years, although those alerts are no longer broadcast by local media or placed on digital highway signs.

DPS re-evaluates Amber Alerts every 24 hours to determine whether they are still helping with the investigation. In a Houston case from 2004, the state Amber Alert was canceled on the third day while the local alert remains in effect today.

Chief Boyd said he understands that the Amber Alert system could lose its potency if it's used too often, but he also noted that it's a critical tool that can't be overlooked during an investigation.

"I hope it was for nothing," he said about the Amber Alert for Elian. "But we still need information, and that's what the system is for."

Sheriff Anderson said it appears that Irving issued the alert because officials ran out of other options.

"The Irving people will certainly have a chance to explain their thought process," he said. "We'll see where it leads us."

Brother of missing toddler to remain in foster care

IRVING, Texas (WFAA ABC 8/The Dallas Morning News) - Four-year-old Alexis Majano will remain in foster care, according to an agreement reached today between his parents and Child Protective Services after a hearing in juvenile court that stretched for more than three hours.

Alexis was taken into protective custody after his 2-year-old brother, Elian, went missing at Irving's Lively Park on June 21. The boy's mother was sitting in a truck with a man authorities described as her boyfriend while her sons were playing outside. At issue is how long the boys were left unsupervised when Elian disappeared.

As part of the today's agreement, Yancy Majano, 24, and her common law husband, Gilberto Bercian, 52, have agreed to psychological evaluations and parenting classes.

Elian remains missing, and police have few clues to go on.

Investigators have two working theories -- that he was abducted or that he fell into a sinkhole at the park created by a broken sewer line. There is no evidence of an abduction and searches of the sinkhole and pipelines have turned up no signs of the boy.

Boy told police his missing brother fell

4-year-old's statement disclosed at emotional custody hearing

IRVING, Texas - Days after his 2-year-old brother disappeared, Alexis Majano pointed toward a sinkhole and told a detective, "Elian fell."

The 4-year-old's statement to police was one of many details that emerged in a custody battle between his parents and Child Protective Services on Wednesday – two weeks after Elian disappeared in Irving's Lively Park.

Irving police believe that Elian was abducted or that he fell into a sinkhole created by a broken sewage line, though there is little evidence to support either theory. CPS officials took Alexis into protective custody after concluding the children were playing unsupervised in the park.

Both sides agreed Wednesday that Alexis would remain in temporary foster care after emotional testimony stretching more than three hours left the boys' mother, Yancy Majano, 24, in tears.

Testimony at times resembled a soap opera.

There was talk of Ms. Majano's alleged affair with the 19-year-old man at the park with her that day. She said the two went to the park because she knew her husband, Gilberto Bercian, would be upset if he knew about the meeting. She also testified that she met Mr. Bercian, 52, when he was in a relationship with her mother. One of his adult children is married to Ms. Majano's sister.

Dallas attorney Raul Loya said his clients agreed to counseling and other terms because they didn't want to go through another day talking about their personal life.

The couple declined to comment after the hearing. Another hearing is scheduled for August.

"I think it was unfair to put her on trial," Mr. Loya said of Ms. Majano. "This is a woman who's been through enough."

CPS spokeswoman Marissa Gonzales said the focus should be on the fact the children were left alone and not on the family's relationships.

"Very young children were left unsupervised," she said after the hearing. "Unfortunately, that brought up all of these other family issues. That this is a very chaotic time for the family adds to the fact that the best thing for the child is to be in foster care now."

It is unclear how long the children were left unsupervised in the park on June 21. Ms. Majano testified that she and the other man let the children out of the truck without getting out. They did not use car seats for the children, she said.

She testified that she paused to put on shoes and noticed Elian was gone about 30 seconds later. Ms. Majano led Alexis through the park as they searched for Elian. A woman who helped them search called 911 at 6:56 p.m., about 30 minutes after Elian had last been seen.

Bloodhounds tracked Elian's scent to the sinkhole near the truck and farther into the park at the playground, but police have said the dogs may have been hitting on Alexis' scent.

Ms. Gonzales said it's not credible that Elian disappeared in seconds and pointed to Ms. Majano's changing stories.

Ms. Majano's statement to police said she and her friend got out of the truck and then let the children out to play. Soon after, Alexis came back alone.

Officer Rogelio Silva testified Ms. Majano was reluctant to identify the children's father the night Elian went missing.

"She refused to answer," he said.

Mr. Bercian was working a late shift at McDonald's when Elian disappeared. He said his wife initially said she went to the park with her sister.

"From that point on, I can't tell you if she's telling the truth or lying," he testified. "I hope that this serves as an experience to think about and see the error of her ways and not commit the same mistakes again."

Detective Oscar Escobar testified that removing Alexis from his parents' custody hasn't helped the investigation.

"I think the family could be more distraught and less likely to cooperate with authorities," he said.

Ms. Majano and Mr. Bercian are from El Salvador and testified through translators.

Mr. Loya raised concerns about whether professional translators were used during police interviews and asked whether police knew Ms. Majano could not read or write. Detective Escobar said no.

Ms. Majano gave mostly one-word answers during testimony and sometimes seemed confused by the questions.

She said Alexis cannot hold a conversation and does not speak much.

"Do you have any idea what happened to Elian?" Mr. Loya asked.

"I think somebody took him."

How do you feel about that?

"Me duele mucho," she responded. "It hurts a lot."

Irving police issued an Amber Alert about 24 hours after an extensive search of the park and surrounding area. The department may be informally reprimanded because there was no evidence Elian was abducted. Tarrant County Sheriff Dee Anderson, a member of local and state alert committees, said the alert should be used when police know there has been an abduction and there is enough information for the public to identify a kidnapper.

At the end of the hearing, Judge Cheryl Lee Shannon ordered the parents to undergo psychological evaluations and to attend parenting classes. They will get weekly visitations with their son, the judge ruled. CPS is considering placing Alexis in the home of a family friend.

"We knew there was a lot going on with the family," Ms. Gonzales said. "We were there because we wanted to make sure that whatever happened was the best thing for the child."

Mr. Loya said the family's issues made the case more emotional, but the focus should be on finding Elian.

"We're looking at a possible abduction, and that's the scariest part of the case," he said.

Amber Alert Issued for 10 Year Old Saskatchewan boy

The Broadview RCMP issued the Amber Alert after the suspect abducted the child early afternoon of Sunday, July 30th.

Zachary Miller 10 years of age. He is a white male, 4'5" tall, 70 pounds with red hair and brown eyes. He was last seen about noon today wearing black track pants with a red and white stripe and runners. Shirt description is not known.

Police believe the child was taken by: Peter Robert Joseph Whitmore of Morinville, Alberta. He is a white male, 35 years of age about 6 feet tall with a heavy build, brown hair and blue eyes. He is a convicted sex offender.

In a news conference aired live on News Talk Radio, a police spokesperson told reporters Whitmore had been seen in the Whitewood area in the last few days and had been in contact with the victim's family in the last few days. RCMP say the level of concern is 'extremely grave' as they believe the Miller 'may come to harm.' Police outside the province have also been notified of the Amber Alert.

The suspect may be driving a 1988 Dodge Caravan possibly with wood paneling and may have Alberta plate CUS 532.

Amber Alert issued for slain mother's child

HOUSTON, Texas (KHOU CBS 11) - Harris County officials said a man who allegedly stabbed his estranged wife now has their 3-year-old daughter.

An Amber Alert was issued for Danielle Jimenez at 7:37 a.m. Monday.

Kidnapped 4-year-old found safe

GARLAND, Texas (WFAA.com) - Garland police canceled an Amber Alert Friday morning after a kidnapped four-year-old boy was found safe.

The child was apparently returned to a relative Friday morning about an hour after the Amber Alert was issued. No other details were available.

Police were seeking Kristi Maloy, 21, in connection with the abduction. Maloy, the child's biological mother, ran over the grandmother's foot and leg as she fled with the child driving a stolen gray 2003 Mitsubishi Galant with Texas plates T93-CKG.

Kentucky State police have issued an Amber Alert for a nine-month-old boy from Henderson, Ky.

A social worker was found dead at the home of the boy's non-custodial mother, Renee Terrell.

The social worker had taken the baby there for a visit.

Terrell is suspected of taking Saige Terrell and the social worker's vehicle.

The suspect has family in both Evansville and Fort Wayne, Indiana.

A statewide Amber Alert has been issued in Kentucky for Saige Terrell, a nine-month-old Henderson, Ky. boy.

Police say the baby is white and has brown eyes, brown hair, weighs 19 pounds and is 2'3" in length and has been missing since 9 a.m. this morning.

Police say the suspect is Renee Terrell, who is described as a white female, with brown eyes, brown hair, 5'5" tall, weighing 240 pounds and wearing glasses.

Police say the baby may have a scratch on the right side of his face and a rug-burn on the back of his neck.

Police say they may be traveling with Chris Luttrell, who is described as a white male, 6'2", weighing 150 pounds.

The suspect's car is described as a white, four-door, Daewoo "Nubia" station wagon with Kentucky license plates: 675-DRV.

Police say the Amber Alert was issued around 6 p.m. and that earlier today a caseworker was found dead.

Authorities are searching for a 33-year-old woman who is the suspect in the homicide of a social worker in Henderson on Monday.

City police said Renee Terrell may have her 9-month-old son, Saige Terrell, and may be traveling in a white, four-door 2000 Daewoo with Kentucky license plate 675DRV.

Terrell - who police said is the non-custodial parent - is a suspect in the homicide of a social worker whose body was found Monday afternoon at 1229 A Clay St. The victim’s identity has not yet been released by authorities.

Henderson police have issued an Amber Alert for Saige Terrell, a white male with short brown hair.

Renee Terrell is described as a white female with brown eyes and brown hair. She is 5 feet 5 inches tall and weighs 250 pounds.

Anyone with information about her whereabouts should contact the police department at 270-831-1295 or call 911.
