The thing is this story really has nothing to do with abortion.. What took place was NOT abortion

How did she manage to kill the child and not herself at the same time? :eek: Agreed, the woman needs an attitude adjustment.

She couldnt wait to deliver the baby first??? She coulda given the child up for adoption instead of ending his/her life. This was selfish cold blooded murder. Nothing less.

BTW here in Virginia she could have LEGALLY left the baby at the hospital and the baby would have been turned over to authorities for adoption. No questions asked.

At this point, absolutely. She carried the baby to full term. There are laws around here as well that people can drop a newborn child off at a hospital or a police station and leave them there - no questions asked - and they won't be charged with abandonment. She must've been totally out of her mind by that time to even consider doing that. Either way she should be doing time in either a jail cell or a mental institution.

And incidents like this got these laws passed. Guess no one reads the paper anymore or watches the news. There was a lot of publicity here in VA when that law got passed.

That happened in Suffolk VA..about 15 miles from me. There is a lot of outrage here over what she did.

Many times the criminal justice system doesnt perform as we think it should. In this case the judge had to apply the law as it is written.

Suffolk -- A judge this morning dismissed the indictment against Tammy Skinner, the Suffolk woman who shot and killed her fetus on Feb. 23, the day the baby was due to be born.

"I'm just glad it's over so I can move on with my life," Skinner told reporters after the court hearing.

Suffolk Circuit Court Judge Westbrook J. Parker made the decision to drop the indictment. An indictment means a grand jury found enough evidence to take a case to trial.

In the early morning hours of Feb. 23, Skinner, a mother of two, called 911 and told police a man shot her in the stomach. Suspicion turned to Skinner's boyfriend, but evidence made investigators conclude that Skinner shot herself. She later admitted to doing that.

Skinner was charged with illegally inducing an abortion, filing a false police report and using a firearm in the commission of a felony.

In May, a General District Court judge dismissed the case, saying Virginia law does not apply to Skinner.

But she was re-arrested on July 11 and charged again, this time in Circuit Court.

Prosecutors wanted to put to the test a 1950 state law that would for the first time hold a mother criminally liable for aborting her child. They wanted to convince a judge that the law, which has remained untested in court for more than five decades, applies to Skinner.

They planned to argue that the law states that "any person" who causes an abortion should be found guilty of a crime.

However, a 2004 law specifically excludes mothers and refers to "any person ... who kills the fetus of another. ..." Lawmakers enacted the 2004 law because they didn't want to punish a pregnant woman as harshly as someone who aborts someone else's fetus.

People think the only way out of an unwanted pregnancy is abortion. And after 2 small children already, you think she would be smarter about birth control. I know no method is 100% except abstinence. But, she would have to be some fertile myrtle for it to fail all 3 times. I am sorry but that act is just cruel and selfish. A baby does not ask to be conceived and brought into this world. And I think every child no matter how it was conceived deserves a chance at life. She could of chose adoption. They are many desperate people out there who can't even get pregnant.
