Just got back from a nice little vacation down on St. Kitts. Got in around 3AM yesterday. Laid down for a bit of sleep. Next thing we know, the man that owns the restaurant next to our commercial building is knocking on the door.....about 5AM. He's in a panic mode. "There is water coming from your building flooding my restaurant!!!" Our building is on the historic downtown square. We have been doing a restoration. A portion of the building is for Yoga and an art gallery. I run across town to discover thousands of gallons of water throughout the building. A water main behind the building failed......the break was just over 4 feet from our rear cargo door. The water filled the cargo bay and began overflowing inside. It was discovered by the local police department when they noticed water streaming out the front door.....70 feet away. I can see it all clearly.....my insurance company will call it an act of god. I'm going to take a baseball bat with me when I meet with the adjuster. I refuse to take another screwing from an insurance company.

If it was a water main that had burst, it is the city's fault for not maintaining the water system.The city is responsible for the damages caused by the water flooding your business and the the businesses.

Good point. I s/w the director of public works for the city of Crystal Springs. He is of the opinion that work trucks installing a new interstate natural gas pipeline ran over an adjacent meter causing the separation from the main. The truck drivers deny that this happened. Even if the city was responsible it is unlikely they could pay. Crystal Springs took a hard lick from Katrina and remains in a declining tax base. Everyone is pointing fingers. It's easier for us to simply absorb the loss. We reconsidered filing an insurance claim. After Katrina, Mississippi Farm Bureau dumped us......now we're with a casualty company......and insured only for catastrophic loss.

I hope that they get it sorted out soon for your sake. I know it is stressful for you every day it goes on unresolved.
