They're striking because they want an increase in the amount of residuals the writer's receive from DVD's (They currently receive $.04. They want $.08 which I think they received with VHS tapes.) and they want residuals from any money made in Internet streaming and Internet downloads.

The control of reality and cartoon show writers and sympathy striking are old matters that (from what I understand may not hold up in court) were nothing but red herrings from WGA. I suspect the WGA would have dropped the issues to show "good faith" in negotiating at some point.

I didn't do anything. . ;) The AMPTP really didn't renew their domain and someone bought it. They decided to use as site to support the writers. It happens all the time. I sure the AMPTP will be trying to buy it back or take the guy to court over it. . .

First things first... ABC has pulled Big Shots effective immediately. Repeats of Private Practice will air Thursdays at 10 for the rest of the month and next week's premiere of Duel will run 90 minutes, saving Samantha Who?'s new episode for later. January schedule will hopefully be announced tomorrow.

AMPTP just released this, read at your own risk, but I had to laugh at the bit about a rock concert.

SETTING THE RECORD STRAIGHT



-- VERSION 2.0 --

The WGA’s organizers made a variety of statements over the past three days that were factually inaccurate.



WGA Statement



Over the weekend, various WGA spokespeople indicated their surprise that the producers opposed the WGA’s efforts to expand the union’s jurisdiction over reality television and animation.



The Facts



Since the start of negotiations, the AMPTP has repeatedly told the WGA that the union’s proposals on jurisdiction in reality television and animation were completely unacceptable. The record is clear:



· Notes from the negotiating sessions reveal that the AMPTP specifically rejected jurisdictional expansion into reality television on July 18, October 5, October 25, October 26, and again on November 4.



· These same negotiating session notes reveal that the AMPTP specifically rejected jurisdictional expansion into animation on July 18, October 5, October 25, October 26, and November 4.





WGA Statement



Various WGA spokespeople have repeated the claim that this strike is about sharing the revenue from new media markets. For example, SEIU President Andy Stern told the Los Angeles Times, "This really is the first significant 21st century strike. It's raising the issues, as work changes, about how prosperity is going to be shared."



The Facts



The negotiations did not break down over new media issues. Instead, the negotiations broke down primarily over one of the most old-fashioned issues of all: The desire of the WGA’s organizers to increase their own power and prestige by expanding the jurisdiction of the union over reality television and animation writers. These jurisdictional expansion efforts have very little to do with the concerns of the working writers who are on strike.

WGA Statement



Patric Verrone told the Associated Press that, in reference to the studios, “I don’t really feel like they are negotiating.”



The Facts



Mr. Verrone was not even present at the decisive negotiating session on Friday, December 7th. Instead Mr. Verrone attended a rock concert and rally held to support the WGA’s still-unsuccessful attempt to organize reality television writers.





WGA Statement



In a letter to members WGA East President Winship writes, “If I hadn't seen and heard it with my own eyes, I might not have believed the extraordinary depths of their dissembling. Last week in Los Angeles, I sat in the caucus room as we waited for the studios and networks to come to the table and negotiate. And waited. And waited.”



The Facts



Mr. Winship may have been in the caucus room, but he never entered the negotiating room, where the negotiating committees from both sides met. The fact is that neither Mr. Verrone, who was at a rock concert rally, nor Mr. Winship saw fit to sit across the table from the producers for this critical negotiating session.





WGA Statement



WGA East President Winship said in a letter to WGA members that “we were told that we would be receiving the second half of” the producers’ proposal.



The Facts



Mr. Winship apparently does not understand what happened in the negotiating room on Friday. The WGA’s negotiating chair, John Bowman, admits in his Entertainment Weekly interview that the producers put more on the table during the day on Friday.



“Q: Does the WGA think any parts of the producers' counter-offer on Friday were reasonable?



A: I think they might publish it on their website; you can sort of look at it. I mean, it certainly was less movement than I would have liked, but nevertheless, it was enough for us -- we wanted to stay there and counter and keep talking.”





WGA Statement



John Bowman told Entertainment Weekly that “we could’ve gotten this done in two days if they’d come in wheeling and dealing, and they’re not.”



The Facts



The WGA’s organizers refused repeated requests by the producers to begin negotiations much earlier, in the spring of 2007. Had negotiations begun when the producers wanted them to start, perhaps the industry would not now be in the midst of this strike.





WGA Statement



WGA negotiator John Bowman wrote “The AMPTP insists we let them do to the Internet what they did to home video.”



The Facts



The AMPTP’s proposed New Economic Partnership offered to share producers’ revenues from the Internet with writers. Because the producers appreciate how quickly the Internet marketplace is changing, the New Economic Partnership’s Internet provisions would sunset in three years – thus allowing all of these issues to be re-examined anew in light of marketplace changes. The WGA’s analogies to the relatively stable home video marketplace are therefore unfair.





WGA Statement



In a letter to WGA East members, organizers provided a lengthy description of the most recent bargaining sessions – much of which is completely incorrect. For example, the WGA East letter says “instead, the AMPTP asked that we break off into smaller groups."



The Facts



The WGA itself suggested a series of "sidebar" discussions at which they insisted on setting aside the critical issue of new media to discuss production of documents, transfer of electronic data, expedited arbitration and the timing of residual payments from MyNetwork TV and the CW.





WGA Statement



The WGA East letter also says that “on Friday, members of the negotiating committee waited all day AGAIN, until the end of the day and week, 6 pm, when the AMPTP finally made a presentation."



The Facts



AMPTP presented its updated New Economic Partnership proposal at about 2:30 p.m. and waited several hours for the Guild to respond.





WGA Statement



WGA negotiator John Bowman told Entertainment Weekly that “what they're doing is they have this sort of bargaining history with us. They always give ultimatums. They say if you won't do this we won't talk to you anymore. Like the night before we went on strike [Nov. 4] they said, ‘Before you take DVDs off the table, we won't give you an Internet proposal.’ And we took DVDs off the table and they didn't give us one.”



The Facts



The AMPTP never demanded that the WGA withdraw its DVD proposal as a pre-condition to making an offer on Internet residuals. In fact, the AMPTP’s actions proved otherwise, as the AMPTP presented the WGA with a wholly new TV streaming residual proposal before the WGA withdrew its proposal to double DVD residuals.

Read Winter Press Tour Officially Struck Down by Strike
So much for getting any juicy inside scoop on American Gladiators. As suspected weeks ago, the Television Critics Association has scrapped any and all plans for its winter press tour, where the casts and producers of midseason series annually tout their wares. "The machinations that forced this outcome were outside our control," TCA president David Walker said in making the announcement. "It was and remains the TCA's preference to stage a January 2008 TV tour... [but] given the current woeful state of the negotiations, as well as broadcast network reluctance to present during a strike, that does not appear possible."

ABC has expanded Duel to 90 minutes on Monday and Tuesday(the 6-night event) and on January 7th has expanded Dance War to 90 minutes.

Still no strike schedule out, but I'm expecting it any day now.

In other news...

The journey is coming to an end for NBC's freshman series "Journeyman."

NBC had until Tuesday to give a full-season pickup to the time-travel drama starring Kevin McKidd. The network let that option lapse, practically canceling the series, which posted its lowest adults 18-49 rating (1.7 rating/8 share) on Monday without a "Heroes" lead-in. The network already tried out fellow rookie "Life" in "Journeyman"'s Monday 10 p.m. slot last week.

Despite the Hollywood writers strike, "Journeyman" was able to complete its 13-episode order.

The remaining two original segments will air as scheduled, an NBC spokeswoman said.

NBC recently handed out full-season pickups to two of its four rookie scripted series, "Life" and "Chuck."

Since the production of most scripted series has been suspended because of the strike, such orders are considered a vote of confidence to the shows and a potential renewal for next season if the additional episodes can't be produced by the end of this season.

In limbo is the fate of the fourth new NBC series, the once-promising "Bionic Woman," which has been sliding in the ratings since its premiere.

NBC Says Goodbye to “Journeyman”

It looks like we won’t be making many more time travelling trips with Dan Vassar as NBC has let the time for renewing the series slip through their fingers, according to “The Hollywood Reporter. The decision date for a pick-up on the series was December 11, with NBC execs. making no statement about the series continuing on the network.

While it is still possible to bring the series back at some later date, as time passes those chances get much slimmer.

“Journeyman’ stars “Rome” actor Kevin McKidd as a San Francisco journalist who finds himself unstuck in time. Unable to control when and where it will happen, his character finds himself revisiting different dates in his past to help others out of terrible situations. .

“Journeyman” was allowed to complete production on its first 13-episodes. The last two will air soon. We can only hope that some other network owned by NBC or others see how good this show really is and give it a second chance, however unlikely that is.

NBC is yet to announce the fate of its other new SF series the “Bionic Woman.” It too slipped by the December 11 deadline for pick-up, but without any announcement one way or the other of its future on the peacock network. NBC’s third new SF series “Chuck,” was picked up to complete its entire first season.

Duo to set timeline on DGA talks

DGA president Michael Apted and negotiating committee chair Gil Cates are authorized to start early contract talks at any time, and an announcement of the start date for negotiations could come as soon as Thursday.

It's unlikely that actual bargaining sessions with the Alliance of Motion Picture & Television Producers will begin before Jan. 1, guild insiders said. But the duo -- who will partner with lead staff negotiator and DGA exec director Jay Roth in the talks -- has received the green light from the DGA board to reach out to the AMPTP to select a start date.

The prospect of imminent AMPTP-DGA negotiations follows the dramatic breakdown in contract talks between the studio group and the WGA on Friday. The DGA is under contract through June 30 but has a history of striking new deals about six months before the expiration of existing pacts.

SAG also has a contract coming due on the same date, but the actors are considered highly unlikely to request negotiations with the AMPTP while the writers are on strike. SAG leadership has been closely aligned with the WGA since the writers launched their talks in July, but DGA brass has largely been silent on negotiating issues over the same period.

It'll either mean

A. An industry-wide strike(the actors contracts are up next summer also) which will kill next season also.

OR

B. The DGA reaches a deal which the WGA will be under INTENSE pressure to accept, but they will get a raw deal.

I really don't know which one is more likely, but I do know the WGA is already under pressure to go back to negotiating. They are starting to upset some people within their union.

NBC and FOX meanwhile are threatening to cancel their May Upfront presentations... for good, and also scrapping the idea of filming dozens of pilots, and cutting costs by going with fewer like cable does(which has arguably been more successful as of late)

No, it's out of episodes because of the strike so it will be going on hiatus. Repeats(almost all of the episodes made) will be airing Mondays at 8:30 through January 21st.
