Katrina Suit Vs. Army Corps Dismissed

NEW ORLEANS (AP) — A federal judge threw out a key class-action lawsuit Wednesday against the U.S. Army Corps of Engineers over flooding from a levee breach after Hurricane Katrina.
U.S. District Judge Stanwood Duval ruled that the Corps should be held immune over the failure of a wall on the 17th Street Canal that caused much of the flooding of New Orleans in August 2005.
The ruling relies on the Flood Control Act of 1928, which made the federal government immune when flood control projects like levees break.

Actually it was the Supreme Court in a decision....Central Green Co. VS. United States 531 U.S. 425 (2001)......on 2/21/2001 that limited the federal governments responsibility of levee failures.

The subject title of this thread shows just how little people know about this screwed up situation. Just because they are immune doesn't mean it isn't their fault. With navigation projects, such as the MRGO, they are not immune. The MRGO caused the flooding of tens of thousands of homes in both St Bernard Parish and New Orleans.
It doesn't mean that it is the fault of the homeowners. It just means that we can add this latest development to the long list of ways people are getting screwed down here. Nothing more, nothing less.

Hey TS.....hope your having a good day. We all know that none of us are at fault for what happened with Katrina. We did the best we could with what we had in the time available.

While the MRGO did enhance flooding in the NO area, NO did flood before the MRGO was dredged. The 1947 hurricane caused extensive flooding in NO.....MGC

That was before any of the levees authorized by the Flood Control Act of 1965 were constructed. Really can't compare the two events.

I agree that anytime you make the decision to live in any area prone to risks such as flooding it is your decision / gamble. The same could be said for those who live in areas subject to quakes, wild fires, hurricane proned coastal areas, tornadoes, etc. as you know the risks. However, the MRGO dredging was not the fault of the people in that area, this clearly was the fault of the government. The people of St. Bernard Parish actively fought for the closing of the MRGO years before Katrina, but it fell on deaf govermental ears.
