Walmart: the company that people love to hate.

500K doesn't seem like a very good settlement. They should have gone for a lot more. I agree with gtalum.

I really don't like Walmart but I say the attorney is at fault. I'd go after him too.

That settlement does seem small of the injuries incurred.

I would have to agree, it is the attornies fault for not getting her enough money to last her the rest of her life. he should have known that they would have to pay Walmart back.

Exactly. It was clearly stated in her health insurance contract.

Do you think the attorney still has his $150,000 to $200,000 fee or do you think he bought a new JAG?

The decent thing would have been for him to reduce his fees, but something tells me he did not do that.

He should have included the estimated cost of her long-term care in the damages for the suit, but failed to do so. Had he done his job, they'd have had the money to pay back Wal-Mart plus a nice nest-egg to ensure her quality long-term care. They should be suing the attorney for malpractice rather than badmouthing Wal-Mart for enforcing the terms of their contract.

You're right about that.

If they were smart they would sue this attorney, I agree with that.

Contracts are not absolute as many believe. It is not totally binding and they are loopholes in them. Their attorney screwed up. Everytime I go into a Wal-Mart, I feel like I am in the world of Idiocracy.

Main Entry: 1con·tract
Pronunciation: \ˈkän-ˌtrakt\
Function: noun
1 a: a binding agreement between two or more persons or parties; especially : one legally enforceable b: a business arrangement for the supply of goods or services at a fixed price <make parts on contract> c: the act of marriage or an agreement to marry.

My health insurance contract clearly states that they are entitled to reimbursement of any and all medical costs if a third party is responsible.

The 500K may have been a tort reform maximum limit. I know here in Mississippi it is 500K.

For one of the first times ever I agree completely with gtalum. I am currently involved in a lawsuit over a car accident that was not my fault and any damages I recover will pay the lawyer, and my medical insurance before any money comes to me.

That's a bad move for Wal-Mart to drop the suit. They'll now face and lose a flurry of suits from other employees from whom they have subrogated successful litigation claims. The net result is the employees will have to pay more for their insurance. :(

Been there done that!!! No amount of money could compensate for my loss of mobility(not total by any means, long story short) and my lawyer got all we could get from the other parties.

Unfortunately, the car insurance covering the medical bills isn't any better. I have Medpay or whatever it is called on my car insurance policy. They were supposed to cover all my medical bills related to my car accident. But, they nickeled and dimed the emergency room bill and various orthopedic bills. The hospital came after me for the difference. My attorney (there was a lawsuit. . . accident wasn't my fault) went after the insurance company regarding the bills. I ended paying the difference out of the settlement.

Wal Mart goofed big time on this deal. Lawyers everywhere will scramble on this one. It sets a bad precedent.

There are reasons not to shop at Wally World. This was not one of them.
