How many times have I heard people on this board say someone is innocent until proven guilty? As of now, Smith is accused - he hasn't been convicted. The State may be going after what they call the ultimate penalty but it's already been reported in one article that I read that some deal may have been reached in exchange for information.

If I'm the father of that girl, and this man kidnapped her, handed her off to another person who actually killed her (highly unlikely), then I want him to pay the same price. So he fries either way!

No, I'm not kidding you. I don't like what happened to this girl, either, but it's up to the justice system to determine his guilt or innocence and his fate - not yours and certainly not mine.

Okay, let's look at what we do know.

1. A car matching the description of Smith's was seen on the surveillance tape three minutes before her abduction.

2. A person matching Smith's description, wearing a mechanic's shirt with a short name on the name badge, was seen taking a girl matching Carlie's description by the hand and pulling her away.

3. Carlie was reported missing on the same day and after the same time as the events on the videotape transpired.

4. Carlie's route home could have taken her through the car wash area, thus confirming the possibility that she is the girl on the tape.

5. Smith's housemate phoned in a tip to police, alleging that Smith resembled the male in the video, thus, in addition to the vehicle on the video, confirming the possibility that he was at the car wash at the time and was the man leading Carlie away.

6. Smith is a mechanic. Joe is a short version of Joseph.

7. Smith was a suspect in a previous kidnapping and false imprisonment case. (Humans are creatures of habit)

8. After conferring with Smith, police were able to locate the body of Carlie.

9. According to the arrest report, Joseph Smith has confessed to kidnapping and killing Carlie.

And I'm sure justice will be served (whatever ones idea of justice is) once the case is over. Until then, he is innocent until proven guilty. I'm not making excuses for him. That's the law. Even John Walsh just said on CNN that he is innocent until proven guilty - and if anyone doesn't like the way the criminal system works, then you need to contact your representatives in Congress and change the system.

The presumption of innocence applies to anyone accused of a crime and in custody so that they are accorded all Constitutional rights (and they have been read those rights -- based on the Fifth Amendment, per the Miranda decision) until the trial or confession has proven their guilt.

He confessed. Do you seriously need more proof?

I think both you folks need to bone up on the law. Regardless of his confession, he has to be found guilty by a jury of his peers in order for the criminal justice system to pronounce him guilty or he must plead guilty at the appropriate place and time. You make it sound like I'm saying that I don't think he did it - which I have never said. Keep twisting my words around - sooner or later you will twist them back into the context that I originally stated.

The horrendous crime being discussed here turns the stomach of each one of us. It is very unfortunate that crimes such as this happen much too often in this troubled world of ours. .......p :(

I couldn't agree more -- you folks saying "see, he did it, CASE CLOSED, YOU WERE WRONG!!!" need to grow up IMO. Yes, it's almost certain that he's the guy now that he confessed, but the fact that you were saying you were sure he was the guy beforehand and Janswizard was being reasonable and saying let's wait and see doesn't mean anything. I think some of you are just so angry over this tragic murder that you feel an intense need to blame someone for it and see them suffer, which is somewhat understandable, but still unreasonable.
