I have to go see a Lawyer today for the first time

#1 Postby HurricaneGirl » Wed Mar 10, 2004 9:10 am

Back in 1997 I had some really bad health issues and medical bills that resulted in me losing me condo and having to foreclose on the mortgage.
Little did I know the Condo Association filed a $3,200+ Civil Lawsuit against me. I never was served with any papers and I didn't even know this was on my Credit Report until my husband and I tried to get pre-qualified for a Mortgage Loan recently.

I had to go to the County Court house and pay $1.00 a page to get the case file copied last week. It was 32 pages!

I am scared and very nervous about this. I have to go see the Lawyer today at 4:00.. Every time I think about that time in my life, my eyes start crying. I am afraid I am going to freak out in the Lawyers Office.

Does anyone have any advice they can give me.

Hey Mary...

I know this advice probably doesn't help lol.. But stay calm.. Take some deep breaths.. and don't allow yourself to get worked up about it.

Find something to do today either at work or wherever that can make you happy.

When you're at the lawyers' office.. Watch what you say and stay calm. If you begin to get nervous.. Don't be afraid to get up and leave for a minute {if you're allowed}..

Of course.. my advice is probably useless lol.. But I figured I'd give it a shot

Don't worry about "freaking out" in the attorneys office. They are used to it and understand. He/she is going to be there to help you through this and will more than likely get it straightened out. If there are loopholes, the lawyer will find it. My best advice to you is go in there like you own the place. lol. Be very honest and you should be fine. :)

Thanks John and Linda!! I am going to try to be as brave as I can, but I think I need a Xanax right about now! I want to get this straightened out as soon as possible, so I can get on with my life and my husband and I can buy a home. As of right now, George can't go with me because he's working in St. Augustine today, so I'm on my own.

Yep, your lawyer is your counselor and advocate. He/she is there to be on your side. Tell everything, don't hold anything back. Laywers have heard it all - there's nothing you tell him that will surprise him or make him angry at you. This sounds like a fairly straight forward case and he might be able to resolve it without goint to court.

I was a defendent in a dog case (imagine that). I got a lawyer, he talked to the DA's office, and it was resolved before we went before the judge, and I won!

HG, first off ... just tell your lawyer everything that happened and specifically the part that you were never notified ... and as for the health and medical issues, you might want to ask your lawyer about that as well to see if there's any reprocussions with that (especially if these problems happened at work) ... You won't be able to help being nervous, but that's completely natural ... but rest assured, your lawyer is there to help you and will work hard for your case.

Also, I'd advise everyone else to regularly get a credit report (generally you can get a free one -- even online -- just make sure you cancel BEFORE the trial period expires if you don't want to be charged anything) ...

Good luck, HG...

Thanks Ed, Anthony and SF! I just heard from George and he is getting off work early and is going to be able to meet me at the Lawyer's Office. So I won't be by myself. Thank GOD!!

I really appreciate everyone's advice and kind words. Hopefully this won't be as bad as I have it built up in my mind to be. It was just a terrible time in my life and I've blocked alot of it out. I was in a deep depression and alot of pain before my surgery.

All that I can clearly remember was having to abandon my condo about 3 weeks after my spinal fusion operation and I was still in a neck brace and hurting real bad.

It's been 7 years since this case was filed against me and hopefully it can be settled out of court.

Thanks again everybody, for all the support! I Love you guys! :D

The lawyer is going to try to get the amount reduced. So all I can do is hope for the best. I'm glad George was there, because I started crying and couldn't really talk to good.
