Capital murder suspect Justin Wayne Smith and his wife, Elizabeth, were en route Sunday to Texas after waiving extradition rights in New Mexico.

Smith, 25, had been missing since Dec. 21, when he was charged in the shooting deaths of his parents, Thomas Henry Smith, 48, and Toni K. Smith, 45. Their bodies were found wrapped in plastic in the kitchen of their Bay City home.

Elizabeth Smith, 20, also has been charged with capital murder, Ruidoso, N.M., police Detective Jim Biggs said.

He said the couple waived extradition during a hearing in Ruidoso on Sunday and were released to Texas Ranger David Maxwell of Bay City.

Biggs said Smith was being held without bail and his wife's bail was set at $1 million.

The couple's 9-month-old daughter, Shelbie, who was with her parents at the time of their arrest, remains in the custody of the New Mexico Children, Youth & Families Department, an agency similar to Child Protective Services, Biggs said.

On Sunday, police searched the cabin where the Smiths were living, Biggs said. He said police also were searching the couple's sport utility vehicle and pop-up camper.

Thank God they found those murderers, hopefully before they killed anyone else!

Very sad about his parents and the baby daughter who had whacked-out monsters for parents. If indeed they're guilty, they should get the death penalty.
