Man arrested for DUI after riding horse to town

SOMERSET, Kent. (Court TV) - Millard Greg Dwyer doesn't deny that he was intoxicated when officers arrested him. But the Kentucky man is disputing the DUI charge by trying to implicate a second party — his horse.

Dwyer reportedly had been drinking heavily at home on May 8 when he decided to ride his horse to get to town.

According to Somerset Police Lt. Allan Coomer, Dwyer's extensive DUI arrest history may have influenced the man's choice to ride the horse in the first place.

"He was probably trying to avoid trouble by using a horse," Coomer said. "He may have learned his lesson about drinking and driving a car."

En route, the horse stepped into the path of an off-duty officer's vehicle. Coomer said the startled officer contacted 911 when he observed that the rider was barely able to stay seated on the animal.

When officers arrived at the scene, Dwyer admitted that he had consumed a twelve-pack of beer. He failed a sobriety test; a breath test revealed his alcohol level to be at .244, more than three times the legal limit in Kentucky.

Dwyer was arrested and charged with operating a vehicle other than a motor vehicle under the influence of intoxicants. But he allegedly took issue with the charge, insisting that he had not been driving and should only have been charged with public drunkenness.

"He said that the horse had a mind of its own and had been in complete control of the situation," Coomer said.

Dwyer also challenged the notion that the horse was considered a vehicle. But according to Coomer, under a Kentucky statute, a vehicle is defined as anything that can transport a person or property across a road. He added that Dwyer has been very vocal to the local media about the unfairness of the charge.

Dwyer was released on $2500 unsecured bond. A relative transported his horse back home.

Woman Arrested for Having Crowded Car

NEWHALL, Calif. (AP) - A woman was arrested after the California Highway Patrol officer who pulled her car over found nine people crammed inside, including two children in the trunk.

"I have never heard of this," said Officer Wendy Hahn. "There was no room left in the car, so she puts two of the kids in the trunk. We're trying to get people to buckle up, and this is what we find."

Lavern Dunlap, 35, of Glendora, was pulled over about 8 p.m. Friday after another driver reported seeing a woman closing the trunk of her Toyota Corolla with two children inside as the vehicle sat parked on a shoulder.

Dunlap told the officer she was heading to her sister's house in Palmdale, about a 60-mile trip.

The officer discovered a 15-year-old boy and a 10-year-old girl in the trunk, four children in the back seat, an adult in the front passenger seat with a child on her lap and Dunlap behind the wheel. No one was wearing a seat belt, she said.

Dunlap was booked on suspicion of child cruelty and was released. She is scheduled to appear next month in court.

Man Allegedly Fires Crossbow at Neighbor

IOWA CITY, Iowa (AP) - A man who police say fired a crossbow at his neighbor was arrested. Dana Lee Cockerman, 48, was charged Sunday with intimidation with a dangerous weapon.

Cockerman was angry at his neighbor about his dog being shot a year ago, and fired the crossbow, narrowly missing the man and a 9-year-old boy, officials with the Johnson County sheriff's office said.

Cockerman had threatened to kill the man and his dog, officials said.

Cockerman was being held under $10,000 bond in the Johnson County jail. If convicted, he faces up to 10 years in prison.

Woman, 86, Jailed for Calling 911 20 Times

CHARLOTTE, N.C. (AP) - An 86-year-old woman has been sent to jail after police said she called 911 dispatchers 20 times in a little more than a half-hour to complain about a pizza parlor. Dorothy Densmore remained in jail Tuesday charged with misusing the 911 system, a jail spokeswoman said.

She told dispatchers Sunday that a local pizza shop refused to deliver a pie to her south Charlotte apartment, said Officer Mandy Giannini, a Charlotte-Mecklenburg police spokeswoman. She also complained that someone at the shop called her a "crazy old coot," Giannini said.

Densmore wanted them arrested. Instead, police came to arrest her, and she resisted, Giannini said.

It's unusual for someone to face charges for nonemergency calls, Giannini said. But on Sunday, Densmore kept calling 911, even after she was told to stop, Giannini said.

When an officer arrived at her apartment, the 5-foot-tall, 98-pound woman attacked him, Giannini said. Densmore scratched him, kicked and bit his hand, she said.

Densmore is also charged with resisting a public officer and two counts of misusing the 911 system, jail records show.

It was the second time she'd been charged with misusing the emergency system, court records show.

In March 2004, police said she called 911 about 10 times after she was asked to stop, a police report says. She then threatened to hit the officer with a chair when he came to arrest her, the report states.

'Star Wars' villain wanted for robbery

SPRINGFIELD, Ill. (Court TV) - It appears that life on the dark side is not so rosy
after all.

When Darth Vader made an appearance at a movie theater in Springfield, Ill., on May 21, he wasn't there to recruit minions or to watch his doppelganger in the sixth and final Star Wars movie, "Episode III: Revenge of the Sith."

Instead, he robbed the cash register.

According to Springfield Police Lieutenant Doug Williams, an unidentified man wearing a Darth Vader mask, black pants and a black shirt walked into the Showplace Eight Theatre at about 9:15 p.m. The man made his way behind the counter of the front cashier area, shoved the employee aside and grabbed an undisclosed amount of money.

Williams said the suspect did not utter a word during the crime, nor could witnesses detect any heavy breathing coming from behind the mask. There was also no sign of the villain's ubiquitous light saber.

The suspect reportedly fled the theater and escaped into a nearby wooded area. Police have no lead in the case.

The man is approximately six feet tall and 150 pounds. Williams said the suspect also wore a green money belt in addition to his all-black ensemble.

Angry mother moons school official

RALEIGH, N.C. (Court TV) - Working out a disagreement like a mature adult was not an option for Donna Maria Thomas.

The 42-year-old North Carolina mother is accused of exposing herself to her daughter's assistant principal.

Authorities in Raleigh, N.C., say Thomas, 42, had a contentious history with officials at her daughter's high school. On May 17, she picketed the school board's headquarters.

"She was protesting the school's disciplinary treatment with regard to her daughter," said Jim Sughrue, a spokesperson for the Raleigh Police Department.

Thomas reportedly saw the high school's assistant principal, Darnell Bethel, arrive for a doctor's appointment across the street and went to confront him. She prevented the man from entering the building and then lifted her dress and exposed her buttocks.

Sughrue said the woman was not wearing any underwear. Bethel reported the incident to authorities and a warrant was issued.

Thomas was arrested on May 19 and charged with simple assault, indecent exposure and communicating threats. A charge of making a harassing phone call was included because of a separate incident involving another school official.

Thomas was released from the Wake County Jail after posting $2000 bail.

Man Arrested After Asking Girls About Feet

MELVILLE, N.Y. (AP) - A Long Island man was arrested on child endangerment charges after he approached two girls on the street, questioned them about their feet and asked them if they wanted to model socks and sandals for him, authorities said.

Andrew Marks, 42, stopped a 14-year-old girl walking her dogs on May 7 and asked her "inappropriate questions about her feet" before driving away, Suffolk County police said in a news release.

The girl told police Marks said he worked in the fashion footwear industry and she could make $400 modeling sandals in his product line, Suffolk district attorney's office spokesman Bob Clifford said Thursday.

A week later, Marks stopped a 15-year-old girl, also walking her dog, police said. That girl told police he offered her money to model socks, took one of her shoes off and massaged her foot for about 10 seconds, Clifford said.

Both girls told police Marks asked them whether they liked to have their feet massaged and requested their telephone numbers, Clifford said.

Marks was found because police had a description of his car and a partial license plate number, police spokesman Officer Robert Boden said.

He was arrested Wednesday and arraigned Thursday on two counts of endangering the welfare of a child. He pleaded not guilty and was released on bail, his lawyer said.

"We believe he is not guilty, and we believe the facts are going to bear that out," defense attorney Amy Cobert Haber said.

She said she believed Marks worked in the women's clothing industry, but she didn't know where.

Police: Taxi Robber Shoots Himself in Foot

ROSWELL, Ga. (AP) - Police say an 18-year-old who robbed a taxi driver shot himself in the foot — literally.

Rodriquez Lamar Massett of Atlanta pulled a handgun after an Acapulco Taxi cab picked him up and drove him to a McDonald's restaurant, Roswell Police Sgt. James McGee said. The suspect took $74 and fled on foot but was spotted by police.

"While the suspect was running, the weapon discharged, striking the suspect in the foot," McGee said.

Massett was transported to North Fulton Regional Hospital with a minor injury, he said.

Officer uncovers marijuana plants among flowers outside Colorado mall

BOULDER, Colo. (Court TV/AP) — A police officer weeded out a pile of marijuana growing alongside some tulips on the Pearl Street Mall.

Officer Mike Pease said he said he uprooted the pot so nobody gets to it.

"It will be placed into property and evidence and labeled for destruction," Pease said.

"We don't know who the owner is, so no charges will be brought against anybody," said Pease.

"This is so funny. This is hilarious. This is so Boulder," said Erika Kriksciun, a graduating senior at Boulder Fairview High School.

Student tries to eat evidence of crimes

Keller: 2 accused of breaking into school

KELLER, Texas - Talk about an appetite for crime.

While one of two Keller High School students charged with breaking into the school to steal test answer sheets was being questioned by police Friday, he tried to stuff newspaper clippings in his mouth.

"The papers were articles from the Keller Citizen about burglaries and thefts in the city," police Lt. Rex Phelps said.

That was all the evidence police needed to start questioning the teens about other burglaries, including a safe taken from a Westlake golf course, a computer tower stolen last month from the high school and office equipment taken from a Keller real estate office.

"They are cooperating with us," Lt. Phelps said. "We have determined that they have been involved in other crimes, and we have recovered some other property."

The boys, ages 15 and 16, were found inside the high school shortly after 4 a.m., Friday, police said. Once inside, the pair took a master key, officials said.

The teens used a crow bar to gain entry into the school located in the 600 block of North Pate Orr Road. They set off a burglar alarm that alerted police, Lt. Phelps said.

When police arrived, they found a Ford pickup parked on the southwest corner of the school next to a door.

After officers entered the school, one boy fled but was quickly apprehended in the parking lot, Lt. Phelps said.

Officers found money strewn along a hallway floor. The money had apparently been taken from the school's library, Lt. Phelps said.

The boys also had collected several items including answer sheets for final exams in chemistry and Spanish and two PowerPoint projectors.

School officials will meet later to determine what disciplinary action to take against the boys, who were transported Scott Moore Juvenile Justice Center in Fort Worth after being charged with burglary.

"Things such as this are expellable offenses," said principal Jamie Wilson. "This happened today, the last day of school. We haven't had the opportunity to meet with the parents, but we'll decide something."

Serial Impersonator Arrested Again

GODFREY, Ill. (AP) - A serial impersonator of law enforcement officials and others has been arrested again — this time for posing as an appliance repairman.

James A. Ross, 23, has served time in jail for false impersonation of a police officer and again for posing as a paramedic. He also has been charged with posing as a firefighter and a mortician.

On Sunday, he was arrested for posing as an appliance repairman at the Woodbury Manor apartment complex. Ross approached two women sitting on a back porch and asked them if any of their appliances needed repair work.

"We're obviously concerned about Mr. Ross and why he can't seem to stop this type of activity," Madison County Sheriff's Lt. John Lakin said Tuesday.

Ross was charged with misdemeanor disorderly conduct, which carries a maximum sentence of a year in jail, police said. He was released after posting $100 bond.

In October, Ross reached a plea agreement with prosecutors on a charge of making a false report of a murder, officials said. He received a two-year prison sentence, but was released on parole March 24.

It was not immediately clear if Ross had an attorney. A telephone listing for Ross in Godfrey could not be found.

Police Say Man Stealing Gas Used Lighter

THURMAN, N.Y. (AP) - A tip for would-be gasoline thieves. When stealing gas in the dark, don't use a lighter to see how you're doing. Police in Warren County say that's what Glen Germain Junior did when he was siphoning gas from a dump truck at a business in the Adirondacks last month.

The sheriff's department says Germain was transferring the fuel from the truck to a gas can when he used a lighter to see how full the container had become.

That sparked a fire that caused minor burns to his face and hands. The fire spread to a nearby forklift, which was destroyed in the blaze.

Germain has been charged with petit larceny and criminal mischief.

The arrest was Germain's second in a month for stealing gasoline from businesses in the town of Thurman, about 65 miles north of Albany.

Man Upset With Pot Dealer Damages Graves

TROY, N.Y. (AP) - Angry at his marijuana dealer, an upstate New York man said he damaged graves near the burial site of the man who became known as Uncle Sam.

Ricky Rockenstire, 32, pleaded guilty to first-degree cemetery desecration Thursday. He will get a year in Rensselaer County Jail for the March 18 rampage, which authorities said caused more than $6,000 in damage to 50 gravestones and statues around the monument to Samuel Wilson, the Troy meatpacker whose Uncle Sam nickname became a national icon.

Rockenstire told the judge Thursday he was mad at his marijuana dealer at the time and just snapped. Authorities said he allegedly knocked the wings and heads from angel statues in Oakwood Cemetery. Rockenstire has been ordered to pay more than $3,000 in restitution.

Rockenstire said his stepson, 17-year-old Daniel Thompson Jr., was present at the time of the rampage. Thompson has a similar case pending in city court.

Man may have set monitoring device, self on fire

GLENN FALLS, N.Y. (Court TV) - Did Jason McClaskey have an appetite for grilled hot dogs at 5:50 a.m., or was he trying to rid himself of the electronic monitoring device attached to his ankle?

Evidence seems to point towards the latter, but police in Glens Falls, N.Y., say they'll conclusively determine the 25-year-old man's motives when he returns from the hospital.

According to Captain Joe Bethel, McClaskey was under house arrest for burglary and was being monitored by a tracking device attached to his ankle. When police and firefighters responded to a call of a fire at the man's residence on May 26, they found an unused grill, badly burnt clothes on the lawn and McClaskey, who was in extreme pain with burns on about 60% of his body.

The burn victim told officers that he had decided to make himself a meal after returning from a bar. He allegedly doused the grill with lighter fluid, but his clothes caught on fire when he tried to light it. Witnesses told authorities that they saw McClaskey burst into flames, and they contacted the fire department.

But Bethel said officers found no food in the vicinity, no charcoal in the grill and no evidence that the grill had been lit. He also mentioned that McClaskey's burns were concentrated on the part of his body with the ankle bracelet. The lighter fluid was collected as evidence.

The burn victim was taken to Westchester Medical Center's Burn Unit, where he's still being held. No charges have been filed.

Woman pulls gun on TV technician

PASCO COUNTY, Fla. (Court TV) - Best Buy service technicians can now add "being held hostage at gunpoint" to their list of potential on-the-job hazards.

A Florida technician for the electronics retailer found himself working under the aforementioned condition on May 27.

The man had been to Marlene Anne Bagnall's residence several times during the week to try to fix a broken television. But when he was unable to repair the item during his last visit and attempted to leave, the woman produced a loaded .38-caliber handgun.

According to an incident report from the Pasco County Sheriff's Office, Bagnall, 44, pointed the firearm at the man and said, "You're not leaving until the TV is fixed."

The man pleaded with Bagnall and told her he would contact his office and have a new television set installed in her home. As the man dialed his cellphone, the woman told him she would kill him and herself if he called police, the report said.

Bagnall let the technician go after confirming with a Best Buy employee on the phone that she would receive a new set. After leaving the house, the man called the sheriff's office.

The woman admitted to deputies that she had been upset because of the broken television and that she retrieved the gun from her car. But she denied pointing it at her alleged hostage. Bagnall's husband later told authorities that his wife suffered from bipolar disorder and was on medication.

Deputies charged the woman with aggravated assault and unlawful imprisonment.

Police looking for naked masked man

DOYLESTOWN, Penn. (Court TV) - Police in Doylestown, Pa., say one of their wanted suspects may think he's Zorro, but the only thing that he shares in common with the fictional swashbuckler is the black mask.

This 21st-century incarnation prefers to do his swashbuckling in the nude, and police want to put a stop to it.

According to Doylestown Police Chief Stephen White, the unidentified man known as the "naked Zorro" has struck at least eight or nine times, but in the neighboring jurisdiction. Always disguised with a black mask and wearing white sneakers, the suspect accosts women walking alone or in groups.

When the naked Zorro struck in Doylestown on May 27, his targets were three teenage girls. The teens were walking on an isolated street at around 11 p.m. when the suspect approached them from behind. The girls fled and contacted police.

"This is definitely not a prank. It's a sexual assault crime," Chief White said.

The nude swashbuckler's antics have also made him a local celebrity — White said "naked Zorro" t-shirts have become popular.

But police find nothing amusing about the naked Zorro's escapades.

"Something could occur that could escalate this into a dangerous situation," White said. "People should contact police if they see anything suspicious."

Naked Zorro is described as a white male of medium build in his 20s or 30s and about 6 feet tall. He has blond curly hair and no facial hair. Anyone with information should contact the Doylestown Township Police at (215) 348-4201.

Man Accused of Robbing Same House Twice

RUTLAND, Vt. (AP) - A Whitehall, N.Y., man is facing charges that he broke into the same home twice in Castleton to steal money for drugs.

Jason Brown, 22, pleaded not guilty Wednesday in Vermont District Court in Rutland to two counts of burglary and two counts of petty larceny. He was ordered jailed for lack of $100,000 bail.

"We submit that due to the serious nature of these offenses, that significant cash bail is warranted," Rutland State's Attorney James Mongeon said in court.

Public defender Steven Zwicky did not contest the bail request.

Castleton Police said the break-ins took place Monday and Tuesday at a home on Corey Road in Castleton. Police said they were called to the home on Tuesday for a report of "suspicious activity" at the home.

The caller identified the suspect as Jason Brown, and said he had just run into the nearby woods, Castleton Police Chief Bruce Sherwin wrote in an affidavit.

The chief wrote that when he arrived at the scene he saw Taylor and three other men near the driveway of the home.

The caller told police that around 10:30 a.m. Monday she left the home to go shopping and when she returned, a change bag with about $300 inside that she kept in her bedroom was missing, court documents said. Blank checks were stolen in a separate burglary.

The checks were recovered, but the change was not.

A background check showed that Brown was on parole in New York for a burglary conviction.

If convicted of the charges against him in Vermont, Brown faces more than 50 years in prison.

Police Officer Pulls Over His Stolen Car

CHARLESTON, S.C. (AP) - An off-duty police officer on a Sunday drive saw something awfully familiar — his recently stolen Volkswagen Jetta.

North Charleston patrolman Ethan Bernardi whipped his cruiser around and pulled over the stolen vehicle. He called other deputies, who arrested three suspects, police said.

"One of the advantages to having off-duty police officers using their patrol cars while off-duty is that they are able to respond to crimes when needed," North Charleston Police Chief Jon Zumalt said.

Investigators don't know how the suspects got the car, which was recently stolen from Bernardi's home.

The driver, Vicki K. Grooms, 42, and two passengers were charged with possession of a stolen vehicle.

Woman Charged With Smuggling Fish in Skirt

SYDNEY, Australia (AP) - There must have been something fishy about the way she walked. Customs officials said Monday they stopped a woman as she arrived Friday in the southern city of Melbourne on a flight from Singapore and found 51 live tropical fish allegedly hidden in a specially designed apron under her skirt.

"During the search customs officers became suspicious after hearing 'flipping' noises coming from the vicinity of her waist," the Australian Customs Service said in a press release. "An examination revealed 15 plastic water-filled bags holding fish allegedly concealed inside a purpose-built apron."

The species of fish was not immediately known, but customs officials warned they could carry diseases that could decimate Australian fish if they escaped into local rivers.

Customs officers will charge the woman once they establish what species the fish are. If convicted of smuggling wildlife, she faces a fine of up to U.S. $83,617 and could also get a prison sentence of up to 10 years.
