Will Emily be retired?

I think it will be retired. Of course, there was the damage in Mexico, especially during the Yucatan landfall. However, more importantly, was the damage on Grenada.
As for Emily being a category five or being the strongest July storm, that has no bearing on retirement. The criteria for retirement is only damage and causalities. (Oh, and the French complaining in cases like Frances)

I agree with you because arn't the winds inside a hurricane contantly fluctuating up and down so it very well might have been a cat. 5 hurricane for at least a minute or so. but then again that is just my opinion

oh ya and when we get rain it only lasts for like 30 min or so and if it is sever it doesn't do anything because it moves to dang fast

Actually, I read somewhere that somebody said that if Frances had not done anything, she would NOT have been retired. Supposedly, the WMO decision had been overturned because Frances was a common American name.

Okay, first, let me make clear that Frances would have been retired regardless to prior arrangements by the WMO. Frances was by far a horrible hurricane causing 7 direct deaths and 42 others indirectly. In addition, France caused an estimated $9b in damage to the US alone. This does not include the widespread damage to the northwestern and central Bahamas.
Those facts alone would have sent Frances into retirement.
However, what I was referring to was the WMO Committee that met in 2002. (http://www.wmo.ch/web/www/TCP/Reports/HC-25FinalReport-eng.pdf)
I hadn't read any reports from the WMO meeting thereafter that said they reversed their decision. It was planned that they were going to retire Frances before the season began. Regardless, I think we all can agree that Frances was properly retired after last season based on the destruction and devastation it caused.

5.20 The Committee recalled that, at its session in 2002, the delegate from France requested consideration of a change of the name "Frances", which is on the list for 2004, to be made at this session. The Committee agreed to change the name after the 2004 hurricane season. The Committee also decided to retire the names of the three hurricanes that caused significant damage and loss of life during 2002. These were Isidore and Lili in the North Atlantic basin, and Kenna in the Eastern North Pacific basin. Regarding a change of the name "Lili", it will be made at the twenty-sixth session of the Committee in April 2004. The other two, i.e. Isidore and Kenna were replaced by the names Ike and Karina respectively, which will be reflected in the WMO RA IV Hurricane Operational Plan.

"Six deaths because of rains" (My translation of Spanish language article in Mexico City mewspaper): Six women were killed when a hill came down on their house due to rains from Emily.

Yesterday, a woman was killed when she and her husband tried to cross (what I believe to be a flooded intersection) in their car. The husband managed to escape, but the wife was swept away (again, Spanish language article)
